Judge: Man accused of shooting at neighbors’ homes to keep GPS monitor

Derek Foote in court

ALBUQUERQUE, N.M. (KRQE) – The man accused of firing shots at neighbors’ homes will keep his GPS monitor on while he awaits trial in three weeks.

Derek Foote appeared in court Monday. Foote was arrested in July after police say he shot at homes and cars in the middle of the night.

Monday morning, his attorney asked the judge to change his conditions of release and remove his GPS monitor citing good behavior. But prosecutors pointed to past issues of compliance.

The judge agreed and denied the defense’s motion.

Foote’s trial date has been set for January 9, 2017.
