Alleged drunk driver arrested after restaurant worker calls police

ALBUQUERQUE, N.M. (KRQE)– An alleged drunk driver’s attempt to drive off with his three young children was halted by an alert restaurant server.

It happened Saturday afternoon at the Sadie’s near 4th and Osuna.

According to a criminal complaint James Forney was stumbling out of the restaurant to his truck with his three kids ranging in age from two to seven.

A deputy caught up with him before he could leave the parking lot.

Investigators say Forney refused a breath test, saying about his blood alcohol content that “I’m sure it’s going to be very high, i don’t want to risk it” and that he “didn’t even want to know.”

Forney was arrested for child abuse and his wife picked the kids up.

Court records show he has two prior DWI charges out of Colorado but it’s unclear if he was convicted in those cases. provides commenting to allow for constructive discussion on the stories we cover.
