Judge excused from hearing case against Michelle Martens

ALBUQUERQUE, N.M. (KRQE) – Court officials say Judge Brett Loveless has been excused from hearing the case against Michelle Martens, who is facing charges in the murder of her daughter, 10-year-old Victoria Martens.

Victoria’s mother, Michelle Martens, her boyfriend Fabian Gonzales and his cousin Jessica Kelley are all facing charges for her murder.

Judge Benjamin Chavez has now been assigned to hear the case after the filing by Michelle Martens’ attorney on Thursday.

Her attorney did not cite a reason and doesn’t have to under state statute. Each side is able to remove one judge without a reason.

The details of this case have stunned the community and made national news. New details about Martens sought out men to sexually assault Victoria have caused even more shock.

Last week, all three suspects pleaded not guilty through their attorneys.

If convicted, all three could get life without parole because the sex crime and murder involved a child.
