LAS CRUCES (KRQE) – A grand jury has indicted Dona Ana County Treasurer David Gutierrez on public corruption charges.
According to District Attorney Mark D’Antonio, Gutierrez is also accused of corruption in office or gross immorality by a public official.
D’Antonio said there will be a jury trial to determine if Gutierrez should be removed from office.
The charges stem from accusations that Gutierrez offered a female employee $2,000 to have sex with him. The incident allegedly happened in 2014 however charges were not filed until county officials requested a DA investigation.
If Gutierrez is convicted he could face up to 18 months behind bars. If he is found guilty in the removal case Gutierrez would be removed from office.
