ALBUQUERQUE (KRQE) – The man accused of shooting and killing 4-year-old Lilly Garcia in a road rage incident was indicted by a grand jury Friday.
Tony Torrez is charged with first degree murder, shooting at or from a motor vehicle with great bodily harm, two counts of shooting at or from a motor vehicle with no injury, two counts of assault with intent to commit a violent felony and tampering with evidence.
The shooting happened on a Tuesday afternoon on I-40 westbound. Investigators say Alan Garcia picked up his children, Lilly Garcia and 7-year-old son, from school and got onto the interstate when he was forced out of his lane by Torrez’ vehicle.
Torrez then shot at Garcia’s vehicle, leading to the death of the 4-year-old.
Torrez has a long criminal history which includes another road rage incident back in 2006»
A statement released from the public defender says while the case has been publicized via media, Torrez is still innocent until proven guilty and deserves a fair trial.
