Judge deciding if suspected child rapist’s case should be dismissed

ALBUQUERQUE (KRQE) – A judge is deciding if a case against a suspected child rapist should be dismissed.

Neil Stammer was extradited back to Albuquerque in 2014 after 14 years on the run.

He’s accused of raping one boy and molesting another.

He fled after he posted bond. The FBI caught up with Stammer in Nepal with a fake passport.

His attorney argued Stammer has waited 16 years to face a trial, violating his right to a speedy trial, even though he was in Nepal most of that time.

The judge says he plans to decide by Friday if his case will move forward.
