Clovis man says he was arrested for stealing his own dog

CLOVIS, N.M. (KRQE) – A man is behind bars for stealing what he says is his own dog. But the criminal complaint tells a different story.

Gerald Martinez and his wife Christi were arrested last week in their Clovis home for burglary charges but they say they did nothing wrong.

“Little did I know we would be brought up on charges, you know felony charges for getting back our own dog,” said Gerald Martinez, who was arrested last week for taking back what he says was his son’s dog.

Martinez says their son’s dog Queen was stolen from his home and they say when they saw a woman walking Queen down the street, they needed to get her back.

Martinez says he stayed in the truck while his wife confronted the girl and took back the dog. They say their son Zachary came out and confirmed it was Queen.

“He got in his car and left, my wife got back in our car and we left and we didn’t think nothing of it,” said Martinez.

The criminal complaint tells a different story. The woman told police Zachary assaulted her, pushed and tried to hit her, snatched the puppy from her hands and took off.

She claims Christi was egging him on the entire time. The woman claims she then saw Zachary driving around her home, taunting her.

Martinez says that’s not true. “As god as my witness he was with us the whole time and like I said we have the mechanic that can testify to that saying he was right there the whole time.”

So, whose dog is it? That’s still unclear. The woman says she has proof the dog belonged to her. Martinez says it belongs to his family.

Police have issued a warrant for the Martinez’s son Zachary.

The family still has the dog.
