Man suing slain deputy after DWI arrest

SANTA FE (KRQE) – A Santa Fe County man is suing the estate of slain Deputy Jeremy Martin. Martin was shot to death in October in Las Cruces, allegedly at the hands of fellow Deputy Tai Chan following a heated argument.

Now 47-year-old Henry Milligan has filed suit against Martin and the county commission accusing Martin of handcuffing him too tightly after a DWI arrest last May.

Milligan claims the handcuffs caused severe pain to his hands and wrists and when he told Deputy Martin, he didn’t adjust them. The lawsuit seeks an unspecified amount in damages.

As for Chan, he’s charged with murder. He’s back home in Santa Fe on an ankle monitor while he awaits trial.
