Hearing rescheduled due to jail mix-up

ALBUQUERQUE (KRQE) – After his twin brother entered a guilty plea in court Thursday Xerxes Peina was scheduled to appear in court Friday, but the jail brought the wrong defendant.

The wrong twin was brought to court Friday.

Both men are accused of contributing to the death of Xerxes’ 3-year-old daughter Sara.

She was hit by a vehicle at an apartment complex while the two men were not paying attention. They were in a fistfight over who had taken money from their mother.

The driver of the vehicle, who ran over the girl twice, driving forward and backing up, was not charged in the death.
