Prosecutor deal clears men of murder charges

Prosecutor deal clears men of murder charges

ALBUQUERQUE (KRQE) – Two men involved in the murder of an Albuquerque store clerk cut a deal with prosecutors and now they won’t face murder charges.

Chad Mercer, 36, was working at the 7-11 on University and Central in 2012 when he was shot and killed during a robbery.

Police say Eloy Aguilar pulled the trigger but Julian De Herrera and Dylan Villarreal were there too.

Under a deal with prosecutors Villareal plead no contest to conspiracy to commit armed robbery and De Herrera plead to armed robbery and conspiracy.

The murder charges against them will be dropped.

Sentencing for De Herrera and Villareal is set for July. Aguilar’s trial is set for June. provides commenting to allow for constructive discussion on the stories we cover.
