Prosecutor deal clears men of murder charges

ALBUQUERQUE (KRQE) – Two men involved in the murder of an Albuquerque store clerk cut a deal with prosecutors and now they won’t face murder charges.

Chad Mercer, 36, was working at the 7-11 on University and Central in 2012 when he was shot and killed during a robbery.

Police say Eloy Aguilar pulled the trigger but Julian De Herrera and Dylan Villarreal were there too.

Under a deal with prosecutors Villareal plead no contest to conspiracy to commit armed robbery and De Herrera plead to armed robbery and conspiracy.

The murder charges against them will be dropped.
