ALBUQUERQUE (KRQE) -There’s a big development in the lawsuit filed by the family of a young woman killed by a former Albuquerque Police Department officer when he ran a red light and slammed into her vehicle.
Sergeant Adam Casaus, who was off-duty at the time of the incident, claims he was chasing a DWI suspect with his lights and siren on however; witnesses didn’t back up his story.
The city tried to say they had qualified immunity against the lawsuit saying Casaus was carrying out his duties as a police officer when the crash happened.
But a judge decided the civil rights lawsuit stands and it has enough merit to go to a jury over APD’s policies about vehicle use
Casaus was fired from APD and charged with vehicular homicide.
