Man pleads not guilty to raping, killing child

ALBUQUERQUE (KRQE) – An Albuquerque man accused of beating, raping and killing his girlfriend’s four-month-old daughter has pleaded not guilty to the charges against him.

Elijah Fernandez, 19, is charged with child abuse resulting in death.

Fernandez called 911 last month claiming the little girl had stopped breathing.

Fernandez claimed she fell from the bed but doctors say the girl had bruises on her face, a severe brain injury and had been sexually assaulted.

She died two weeks later.

Police said Fernandez later acknowledged hitting the baby in the face because he was stressed about money and was angry over her crying.

Today in court, Fernandez’s lawyers asked for his bond to be reduced but the judge didn’t go for it.

“I’m not interested in setting a cash or surety bond in this matter. Mr. Fernandez does pose a threat to the community. I’m going to set bond at $150,000 cash only.”
