RIO RANCHO, N.M. (KRQE) – A grand jury didn’t buy the claim that a Rio Rancho man killed another in self defense.
The grand jury indicted Donald Alber, 66, on one count of first-degree murder and one count of attempted murder.
He’s accused of stabbing Gary Morrin, 25, and Ashley Garcia, 25, at his home in the Enchanted Hills subdivision earlier this month.
According to court documents, Ashley Garcia had been living with Alber and went to get her belongings when a fight erupted.
That’s when she says Alber got a gun and shot her while she was hiding in a closet, then shot Morrin as he fled the home.
Police say Alber was beaten during the incident.
