Man gets max sentence for fatal DWI crash

ALBUQUERQUE (KRQE) – The repeat drunk driver who caused a wreck that led to the death of an unborn baby has received the maximum sentence.

Ramon Hernandez was sentenced to more than nine years behind bars for the June 2012 crash.

Zach and Aileen Smith were driving on I-25 on their way to California when Hernandez slammed into them.

The crash forced Aileen, who was seven months pregnant, to have an emergency C-section.

The baby, named Demitri, lived for just one minute.

The Smiths are joining Gov. Susana Martinez this legislative session with a bill called Demitri’s Law which would toughen penalties for drunk driving.

Hernandez had four DWI convictions before this crash. provides commenting to allow for constructive discussion on the stories we cover.
