Murder charges dropped for man’s wife

ALBUQUERQUE (KRQE) – An Albuquerque woman is no longer charged in the death of her husband.

Amy Herrera allegedly shot her Air Force husband, Marc Herrera, in their northeast Albuquerque home after a party in 2012.

She claims he put the gun in his own mouth and forced her to pull the trigger.

At one point, Herrera was charged with first-degree murder, but that was later changed to a lesser charge of second-degree murder.

However, her defense attorney claimed the prosecutor’s conduct during the second grand jury was inappropriate.

The state Supreme Court agreed and now that indictment has been dropped.

Prosecutors are now seeking a preliminary hearing to try to indict her for a third time. No date has been set. provides commenting to allow for constructive discussion on the stories we cover.
